OVERVIEW
Welcome to Sixteen Layers.
Sixteen Layers is an online fashion retailer operated by N&D Commerce VOF, a partnership registered in the Netherlands.
Throughout these Terms of Service, the terms “Sixteen Layers”, “we”, “us” and “our” refer to N&D Commerce VOF, operating the Sixteen Layers online store.
These Terms of Service govern your use of our website, products and services (collectively, the “Services”). Our store is hosted by Shopify, which provides the e-commerce platform that enables us to offer our products and Services to you.
By accessing our website, placing an order or otherwise using our Services, you agree to these Terms of Service together with our Privacy Policy, Refund & Return Policy and Shipping Policy.
Nothing in these Terms limits or excludes any statutory consumer rights that cannot legally be limited or excluded under applicable law.
SECTION 1 – ACCESS AND ELIGIBILITY
By using our Services, you confirm that you are legally capable of entering into a binding agreement under the laws applicable to you.
If you are under the age of majority in your country of residence, you may only use our Services with the consent and supervision of a parent or legal guardian where required by law.
You agree to provide accurate, current and complete information when placing an order or creating an account.
You are responsible for maintaining the confidentiality of your account details and for activity carried out through your account.
You may not use our Services for any unlawful or unauthorised purpose.
SECTION 2 – PRODUCTS
We make reasonable efforts to display our products, colours, materials, measurements and other characteristics as accurately as possible.
However, colours and appearance may vary slightly depending on your device, display settings, lighting conditions and photography.
Product measurements may also be subject to reasonable manufacturing and measurement tolerances where stated on the relevant product page.
Product descriptions, availability and pricing may be updated from time to time.
We reserve the right to discontinue products, limit quantities or restrict the availability of products where reasonably necessary.
Nothing in this section affects your statutory rights where a product is defective, damaged, incorrectly supplied or does not conform to the description provided.
SECTION 3 – ORDERS AND CONTRACT FORMATION
When you submit an order through our website, you make an offer to purchase the selected products.
A contract between you and Sixteen Layers is formed when your order has been accepted and confirmed by us following successful payment authorisation.
We reserve the right to refuse or cancel an order where reasonably necessary, including in cases of:
- suspected fraud or unauthorised payment;
- incorrect pricing or obvious technical errors;
- product unavailability;
- incorrect customer or delivery information;
- suspected misuse of promotions; or
- circumstances that make fulfilment impossible or unlawful.
If we cancel an order after payment has been received, the relevant amount will be refunded using the original payment method.
Please review your order carefully before submitting it.
Customers may request cancellation within 1 hour of placing an order.
After this period, the order may already have entered processing and can no longer be cancelled.
This cancellation provision does not affect any statutory withdrawal or consumer rights that may apply under applicable law.
SECTION 4 – PRICES AND PAYMENT
Prices are displayed in the currency selected or made available for your market.
The total amount payable will be displayed before you submit your order.
We offer free shipping on all orders, with no minimum purchase required.
Applicable taxes and VAT that we are legally required to collect or disclose will be shown as required before the purchase is completed.
Prices, promotions and discounts may change without prior notice. Any changes will not affect orders that have already been accepted by us.
You agree to provide complete and accurate billing and payment information.
SECTION 5 – SHIPPING AND DELIVERY
Orders are processed within 1–2 business days.
Orders placed after 11:59 PM (CET/CEST) will be processed on the next business day.
Once your order has been processed and shipped, delivery usually takes 6–8 business days, depending on the destination and carrier operations.
The estimated total shipping time is therefore 7–10 business days.
We offer free shipping on all orders, with no minimum purchase required.
As soon as your order has been shipped, you will receive a confirmation email containing your tracking number.
You can track your shipment via the website of the relevant carrier, such as USPS, UPS, FedEx, DHL, Evri or Royal Mail.
Delivery dates and timeframes are estimates unless we expressly state otherwise.
While we do our best to ensure timely delivery, delays may occasionally occur due to circumstances beyond our reasonable control, including carrier congestion, customs procedures, weather conditions or unforeseen logistical issues.
For consumer orders, the risk of loss of or damage to the products remains with us until you, or a third party designated by you other than the carrier, physically receives the products, except where applicable law provides otherwise.

Nothing in this section affects any statutory consumer rights that cannot legally be excluded.
SECTION 6 – RIGHT OF WITHDRAWAL, RETURNS, REFUNDS AND EXCHANGES
Customers may request a return within 30 days from the date of receiving their order.
Items must be returned in their original condition, unworn, unused and, where applicable, with the original tags attached.

Return shipping costs are the responsibility of the customer unless the item received is defective, damaged or incorrect.
Once we have received and inspected the returned item, the refund will be processed within 10 business days.
The applicable purchase amount will be refunded via the original payment method used at checkout.
The time required for a returned item to reach our facility may vary depending on the customer's location and the shipping carrier.
Refunds can only be issued after the returned item has been received and inspected.
We accept exchanges for a different size or colour of the same item, subject to availability.
Customers wishing to request an exchange should contact customer service before returning the item.
Consumers may also have statutory withdrawal rights under applicable consumer law.
For consumers in the European Union and European Economic Area, the statutory withdrawal period for qualifying distance purchases is generally at least 14 days from receipt of the goods, subject to applicable exceptions.
Our 30-day return policy is intended to provide return rights in addition to any mandatory statutory rights that may apply.
Nothing in our Refund & Return Policy or these Terms restricts statutory consumer rights that cannot legally be excluded.

SECTION 7 – DEFECTIVE, DAMAGED OR INCORRECT PRODUCTS

Where an item is confirmed to be defective, damaged or incorrect, return shipping costs will not be the responsibility of the customer.
Depending on the circumstances and applicable consumer law, an appropriate remedy may include replacement, exchange, refund, price reduction or another remedy required by applicable law.
Consumers are entitled to products that conform to the purchase agreement and applicable consumer law.
Nothing in this section limits any statutory rights available to consumers.
SECTION 8 – INTELLECTUAL PROPERTY
The content of our website, including our branding, logos, graphics, photographs, designs, text, videos, layout and other materials, is owned by or licensed to Sixteen Layers unless otherwise stated.
Such content is protected by applicable Dutch, European Union and international intellectual property laws.
Our website and its content are provided for your personal and non-commercial use.
Without our prior written permission, you may not reproduce, distribute, modify, republish, commercially exploit or otherwise use our protected content except where permitted by law.
Third-party trademarks, names and content remain the property of their respective owners.
SECTION 9 – THIRD-PARTY TOOLS AND LINKS
Our Services may include tools, integrations, payment providers, tracking services or links operated by third parties.
These third parties may operate under their own terms and privacy policies.
We are not responsible for independent third-party websites or services that are outside our control.
However, nothing in this section limits any responsibility that we are legally required to retain in connection with the fulfilment of your purchase from Sixteen Layers.
You should review the applicable terms and policies before using independent third-party services.
SECTION 10 – SHOPIFY
Our online store is hosted by Shopify.
Shopify provides the technological infrastructure that allows us to operate our online store.
Your purchase agreement is with Sixteen Layers / N&D Commerce VOF, not with Shopify.
Shopify may process certain personal information in connection with providing its platform and related services.

SECTION 11 – PRIVACY
We process personal information in accordance with our Privacy Policy and applicable data-protection legislation.
Our Privacy Policy explains, among other things, what information we collect, why we process it, how it may be shared, how long it may be retained and what rights you may have.
By using our website, you acknowledge that personal data may be processed by service providers that assist us with functions such as hosting, payments, fulfilment, analytics, communications and delivery.
SECTION 12 – FEEDBACK AND REVIEWS
If you submit a review, photograph, suggestion or other content to us, you confirm that you have the right to provide that content.
You must not submit content that:
- infringes intellectual property or privacy rights;
- contains unlawful, defamatory or abusive material;
- is deliberately misleading;
- contains malware or harmful code; or
- falsely impersonates another person.
Where you voluntarily submit content for publication, you grant us a non-exclusive, worldwide, royalty-free licence to use, reproduce and display that content in connection with our business and Services, subject to applicable law.
Nothing in this section transfers ownership of your original content to us.
SECTION 13 – ERRORS AND INACCURACIES
Occasionally our website may contain typographical errors, inaccuracies or omissions relating to product descriptions, prices, promotions, availability, shipping information or other content.
We may correct genuine errors and update information where reasonably necessary.
Where an error affects an order you have already placed, we will act in accordance with applicable contract and consumer law.
We will not use this provision to retrospectively change an agreed price or other material contract term where doing so would be unlawful.
SECTION 14 – PROHIBITED USES
You may not use our website or Services:
- for unlawful or fraudulent activities;
- to infringe the rights of another person;
- to distribute malicious software or code;
- to obtain unauthorised access to systems or accounts;
- to scrape or collect personal information unlawfully;
- to interfere with the security or operation of the website;
- to impersonate another person;
- to send spam or other unlawful communications; or
- for any other activity prohibited by applicable law.
We may restrict or terminate access to our website where we reasonably believe these Terms have been materially violated.
SECTION 15 – PROMOTIONS AND DISCOUNTS
We may offer promotional codes, discounts or temporary promotional campaigns.
Additional terms may apply to individual promotions.
Unless otherwise stated, promotions:
- are subject to availability;
- cannot necessarily be combined;
- may apply only to selected products or markets; and
- may be withdrawn or corrected where there has been an obvious error or misuse.
Any specific promotional conditions displayed with the relevant offer will apply in addition to these Terms.
Nothing in this section permits us to use misleading pricing, false scarcity or misleading promotional claims.
SECTION 16 – SUSPENSION OR TERMINATION OF WEBSITE ACCESS
We may suspend or restrict access to our website where reasonably necessary for security, maintenance, legal compliance or misuse prevention.
Termination or restriction of website access does not remove rights or obligations relating to orders already accepted, unless otherwise permitted by law.
Sections that by their nature should continue after termination will remain in effect.

We aim to keep our website accurate, secure and available.
However, we cannot guarantee that the website will always be uninterrupted or completely free from technical errors.
Nothing in these Terms excludes or limits:
- statutory consumer rights;
- legal guarantees or conformity rights;
- liability that cannot legally be excluded or restricted; or
- any remedy available to you under mandatory applicable law.
Any disclaimers in these Terms apply only to the maximum extent permitted by law.
SECTION 18 – LIABILITY
To the maximum extent permitted by applicable law, we are not responsible for losses that are not a reasonably foreseeable consequence of our breach or that result from circumstances outside our reasonable control.
We do not exclude or limit liability where doing so is prohibited by law.
In particular, nothing in these Terms limits mandatory rights or remedies available to consumers under applicable consumer law.
If you use our Services primarily for commercial or business purposes, additional limitations permitted under applicable law may apply.
SECTION 19 – SEVERABILITY
If any provision of these Terms is found to be invalid, unlawful or unenforceable, that provision will be interpreted or limited to the minimum extent necessary.
The remaining provisions will continue in full force and effect.
SECTION 20 – WAIVER AND ENTIRE AGREEMENT
If we do not immediately enforce a provision of these Terms, this does not mean that we waive our right to enforce it later.
These Terms, together with the policies and information incorporated into them, form the agreement governing your use of our Services and purchases from us.
Nothing in this section excludes information or rights that applicable law requires to form part of the agreement.
SECTION 21 – ASSIGNMENT
You may not transfer your contractual rights or obligations to another person where this would materially affect our rights without our prior consent, except where applicable law allows otherwise.
We may transfer our rights or obligations to another business as part of a restructuring, sale or transfer of our business, provided that doing so does not reduce your statutory rights.
SECTION 22 – GOVERNING LAW AND DISPUTES
These Terms and contracts concluded with Sixteen Layers are governed by the laws of the Netherlands, subject to any mandatory consumer-protection rules that apply to you.
If you are a consumer residing in another country, this choice of Dutch law does not deprive you of mandatory protections provided by the law of your country of habitual residence where those protections apply.
We encourage customers to contact us first if they have a complaint or dispute so that we can attempt to resolve the matter directly.
Nothing in these Terms restricts your right to bring a claim before a competent court where applicable consumer law gives you that right.
SECTION 23 – CHANGES TO THESE TERMS
We may update these Terms from time to time to reflect changes to our Services, business practices or applicable law.
The most recent version will be published on this page together with the date on which it was last updated.
Material changes will apply prospectively where required by law.
Changes will not retrospectively reduce rights relating to an order that was already concluded unless applicable law permits this.
